Teens 'beat police dog with bat'

    AAP

    June 09, 2009 06:52am

TWO teenagers face animal cruelty charges after they allegedly beat a police dog with a baseball bat.

A police canine unit and local police from Altona North, Williamstown and Laverton in Melbourne's west were called to the Newport rail yards last night after a report of four men seen climbing the yard's perimeter fence about 7.30pm (AEST).

An 18-year-old Tullamarine man was remanded in custody and will face the Melbourne Magistrates' Court today charged with criminal damage, possessing controlled weapon, trespass, possessing a graffiti implement and beating an animal under the Prevention of Cruelty to Animals Act.

Two other men, aged 18 and 19 from Craigieburn, were charged with the same offences - except the 18-year-old will not face animal cruelty charges - and bailed by police.

They will face the Sunshine Magistrates' Court on September 1.

Another man, 19, was taken by ambulance to the Western Hospital with serious bite wounds, and will be interviewed later in the day.

    Disgusting.

Our unsung hero's. People forget what these wonderful dogs have to deal with each shift.

I feel however, that just maybe, the guys will get out of this with a self defence claim... who knows.

    Hope the dog is OK.

Police Officers are only allowed to use "reasonable force". If the courts feel that letting a dog go on these guys and allowing it to bite them was beyond reasonable force, then the guys in my opnion will not be charged, but can claim self defence. Also if that is the case then the police officer concerned can be charged.

Thats how I see the law anyway.

Yes I hope the dog is OK.

But for all of you here know this, this is as real as it gets and this is what the security dogs, and guards face every day.

This is as real as it gets and although i appreciate all sports and i am grateful for their existence I don't think that any sport can Duplicate or even compare with the emotions and the stress that the police and security dogs face on a daily basis.

We come across groups of people, and some in desperation will do almost anything to get away. Guards and their dogs face up to people with knifes, rocks, sticks, etc.

The cans or rattler sticks although testing the dogs nerves are only tests the real deal is out there dealing with the public, and don't forget that some are not rational due to alcohol or other drugs.

My dog and i have faced up to a group of 30 teenagers throwing everything at us that they could lay their hands on. What an adrenalin.

    Re: Police dog bashed.

    Ps.

The law states that we the guards and dogs as well as the police can only use equal force to the force being used against us.

Just because some one is caring a baseball bat is no excuse to use excessive force.

It is a gray area and one that is always on the side of the offender (in court) as they can come up with so many excuses, and the guards and their dogs have to prove to the court that the use of force was warranted.

Further i would like to say that if the dog is NOT SOCIAL which means that it is not trained with an off switch it can be deemed as DANGEROUS and the dog and the handler can be charged for the use of excessive force.

It is not easy out there and although we want the real dogs that will stand up to anything we have to socialize them and train them in a way that they can be called out and safe.

On the other hand we deal with kids and elderly people and if the dog as much as barks at them it can be seen as excessive.

So the pressure to have a stable dog that can work at both ends of the spectrum is enormous. The dogs have to have strong nerves and at the same time be social and anti social depending on each situation.

These extremes can come at you within seconds apart when a stable situation turns to dangerouse and the dog has to respond accordingly.

And NO SPORT CAN DUPICATE THAT FOR REAL

Mark, I am considering the police are trained not to use their dog unless necessary. And considering there where 4 and 2 had weapons, the handler might have been engaged.
It also said police dog, not secruity or guard dog, so I'm thinking he was on duty..

Yes they are Ena.. but how many times have you seen police being charged for excessive force. I am not sugesting here they did. I am just showing how difficult a situation they are in. They are in a very difficult postion.

If the guys were running away, and had done nothing but entered a place illegally..and even if they had knives and a baseball bat.. it is not reasonable force to use a firearm or a dog off leash. If the guys turned and phyiscally threatened the police officer or another person, with these weapons, then extreme force could be justified.

But I am sure they used the force that was necessary at the time.

I hope the dog is OK.. and the police officer carried out his duty as required

    Yes Mark

I agree and also to as you said the Police Have Guns as backup security guards don't, they can only rely on their dog.

and to Ena Yes you are correct the story was about a Police dog But i would like to point out that the security guards go through the same every day and they have less power then the police.

i agree with adam on the last post we have to put our selve in some dangerous places just to keep the situation from going from bad to worst b ut we only hear about how well the police did in that situation

i have been in situations were police wont go untill we have the situation under controll in some situation with the k9 and most with out
so for me hearing other securitys peoples storie is great makes u feel like you have done some thing good

also i hope the k9 is doing well
but in this day and age i dont think much will happen to the people that did the damage at least the one that got bit got some payback
    Regards
